Emilio Lozoya Austin, former director of Pemex accused of corruption, managed to have the investigations being postponed again along with his family, both in the purchase of a junk plant from Agro Nitrogenized, as in the case Odebrecht.
The former official connected by videoconference with his mother, Gilda Austin and his sister, Gilda Susana; in addition to the defense that assists him in both accusations. It has been more than a year since the process began and they have not highlighted any major progress, except for the postponements to gather evidence.
In the two hearings on August 27, it was granted the same period of three months for the closing of the complementary investigations, by the Federal Judge of Control of the North Prison, José Artemio Zúñiga Mendoza.
About the case Agro Nitrogenized, the judge exhorted the General Prosecutor of the Republic (FGR) and the legal advisers of Mexican oil (Pemex) so that, with the accused, set up talks and reach an agreement. It should be noted that none of the agencies opposed the request for an extension that will expire on November 19.
For the second hearing, the judicial authority accepted the arguments of the defense of Emilio Lozoya, because they explained that they have to translate several documents received from Germany, Brazil and Belice. In addition, the legal representation argued that the FGR it does not have translators for these proceedings. The deadline for this case will expire on November 3.
According to the accusations, Lozoya Austin received $ 3.5 million in bribes in exchange for promoting from Pemex, the purchase at a premium of the scrap plant Agro Nitrogenados from the company AHMSA, which led Alonso Ancira. Something that happened in 2014, when the parastatal paid USD 475 million for a plant that was worth 58, according to the appraisals.
But now he would seek to extend the process to reach a reparatory agreement with the FGR and not set foot in jail.
The FGR has also accused him of participating in the network of bribes that the construction company Odebrecht would have paid, between 2013 and 2014, to the government of Enrique Peña Nieto, in order to continue to be favored with contracts.
The resources that Lozoya Austin would have received from Odebrecht are USD 10.5 million, and thanks to them, the Brazilian company benefited from USD 39 million for the award of works.
With those close to 120 million pesos delivered to the former director of Pemex, Peña Nieto and Luis Videgaray Caso, former Secretary of the Treasury, allegedly ordered that it be distributed among various legislators of the opposition National Action Party (PAN) to approve the 2013 energy reform.
Just last August 3 the Financial Intelligence Unit (UIF) reported that he had submitted the seventh complaint against the former director of Pemex. In these accusations It is pointed out that it has diverted 1,400 million pesos from Pemex to Odebrecht and later to front companies located in various states of the Mexican Republic, between 2012 and 2016.
Emilio Lozoya Austin was arrested on February 12, 2020 in Spain, where he was imprisoned for five months, but after an agreement with the FGR, he was extradited to Mexico. Since then, he has not stepped on any court, much less jail. His legal process has been very comfortable: at liberty and without a hearing.
At the beginning of August of last year, he presented a complaint of facts before the FGR in which he implicated 70 persons, between physical and moral, in possible acts of corruption related to the Brazilian company. Among the most important characters are former presidents Enrique Peña Nieto, Felipe Calderon and Carlos Salinas de Gortari.
The document includes 17 high-profile politicians in total including four former secretaries of state, eight former senators, a president of the Senate, a former governor and three current governors; as well as five former officials, four businessmen and even a journalist and a media outlet.
In this scheme would have also participated Ricardo Anaya, then president of the Chamber of Deputies. But the PAN has declared himself politically persecuted because the FGR began or to prosecute the investigation that involves him and for which he fled to the United States, although he will have to return for his next hearing on October 4.
Currently, Emilio Lozoya is following his process at liberty by wearing a bracelet, as he was forbidden to leave Mexico City and, therefore, the country. The former collaborator of Peña Nieto remains linked to process for criminal association, money laundering and bribery for the cases Odebrecht and Agro Nitrogenados.
